Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BuyNau mobile app and admin website (the “Service”), provided by Synterra Limited (“BuyNau”, “we”, “us”). By creating an account or using the Service you agree to these Terms.

1. Eligibility

To use the Service you must be at least 18 years old, be a current employee of a partner employer, and be able to enter into a binding contract under the laws of Papua New Guinea.

2. Account Registration

You must provide accurate, complete, and current information when you register. You are responsible for keeping your account password and device secure, and for any activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3. The Loan Service

BuyNau offers short-term loans to verified employees of partner employers. Each loan request is subject to BuyNau’s review and approval. Approval, credit limit, interest rate, fees, and repayment schedule are presented in-app before you accept any loan, and form part of your loan agreement.

We may decline or cancel a loan request at our discretion, including where we cannot verify your identity, employment, or salary, or where we determine that approval would put you at material risk of default.

4. Repayment

You agree to repay each loan in accordance with the schedule shown in the app at the time of approval. Repayments are made exclusively by payroll deduction arranged with your employer’s HR department. By accepting a loan you authorize your employer to deduct the agreed repayment amounts from your salary on each scheduled pay date until the loan is fully repaid.

Missed or late repayments — for example because of a payroll-cycle gap, a change of employer, or a deduction failing — may result in late fees, account freezing, restriction on further loans, and direct follow-up with your employer’s HR contact to arrange catch-up repayment. Persistent default may also be reported to credit-reference bodies as permitted by law.

5. User Obligations

You will use the Service only for its intended purpose.
You will provide truthful information about your identity, employment, and finances.
You will not allow another person to use your account.
You will not attempt to circumvent the Service’s security or rate limits.
You will comply with all applicable laws in your use of the Service.

6. Prohibited Conduct

You may not use the Service to commit fraud, launder money, finance illegal activity, harass any person, infringe intellectual-property rights, or interfere with the Service’s operation. We may suspend or close your account for any of these reasons.

7. Intellectual Property

BuyNau, the BuyNau logo, and all software, content, and trademarks displayed in the Service are owned by Synterra Limited or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, BuyNau’s aggregate liability arising from or relating to your use of the Service will not exceed the total fees and interest you have paid to BuyNau in the twelve months preceding the event giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages.

10. Termination

You may close your BuyNau account at any time after settling any outstanding loan balance. We may suspend or close your account if you breach these Terms or if we are required to do so by law. Provisions which by their nature should survive termination (including loan-repayment obligations, disclaimers, and limitations of liability) will survive.

11. Governing Law

These Terms are governed by the laws of Papua New Guinea. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Papua New Guinea.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you in the app of material changes. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
